1. Acceptance of These Terms
These Terms of Use (the "Terms") govern your access to and use of the website located at www.lewisbolt.com and any related pages, product catalog, galleries, forms, and content we make available (collectively, the "Site"). The Site is provided by Lewis Bolt & Nut Company ("Lewis," "we," "us," or "our").
By accessing or using the Site, you acknowledge that you have read, understand, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Site.
These Terms govern use of the Site only. Any purchase, order, or sale of Lewis products is governed by our separate sale terms, quotation, acknowledgment, or written contract — not by these Terms (see Section 4).
2. Who May Use the Site
The Site is intended for businesses and professionals in the rail, bridge, track, and related industries. It is not directed to consumers or to children, and it is not intended for anyone under 18. By using the Site you represent that you are at least 18 years old and, if you use the Site on behalf of a company, that you are authorized to accept these Terms for that company.
3. Limited License to Use the Site
Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to access and view the Site and to download or print its content solely for your own informational, non-commercial business use in connection with evaluating or doing business with Lewis.
You may not, without our prior written permission:
• copy, modify, reproduce, republish, frame, distribute, or publicly display Site content beyond the limited use above;
• use the Site content in any product, catalog, or derivative work, or post it to any other website or public repository;
• remove or alter any copyright, trademark, patent, or other proprietary notice;
• use any robot, spider, scraper, or other automated means to access, harvest, or copy Site content or data (see also our robots.txt directives);
• attempt to gain unauthorized access to, interfere with, damage, or disrupt the Site, its servers, or connected networks, or circumvent any security or access control; or
• use the Site for any unlawful purpose or to transmit unlawful, infringing, harassing, or malicious material.
We may revoke this license and restrict or terminate your access to the Site at any time, with or without cause and without notice.
4. Product Information, Specifications, and Quotes
The Site presents descriptive information, drawings, images, and specifications for Lewis products (including bolts, nuts, washers, spikes, screw spikes, hook bolts, rail anchors, and related fasteners). This information is provided for general reference only.
• Not an offer. Nothing on the Site is an offer to sell, a price quotation, or a binding commitment. Product availability, dimensions, materials, tolerances, finishes, and other specifications are subject to change without notice.
• Quotes and orders control. Any sale is subject to a written quotation, order acknowledgment, or contract issued by Lewis, and the terms of those documents (including any tariffs, specifications, warranties, and conditions of sale stated there) supersede information shown on the Site.
• Suitability. You are responsible for confirming that any product is suitable for your intended application, and for compliance with all applicable engineering standards, railroad specifications, and safety requirements. Contact us to confirm current specifications before relying on them.
5. Submissions — Quote Requests, Contact Forms, and Ideas
The Site lets you contact us and request quotes through forms (for example, our contact form, quote request, and "tell us what you'd like us to produce" feature).
• Information you submit through these forms is used to respond to your inquiry and is handled as described in our Privacy Policy.
• Except for personal information (which is governed by the Privacy Policy) and any information covered by a separate written confidentiality agreement, any suggestion, idea, product concept, or other material you submit is non-confidential and non-proprietary. You grant Lewis a perpetual, irrevocable, worldwide, royalty-free license to use, reproduce, modify, and incorporate such submissions for any purpose, including developing and marketing products, without obligation or compensation to you.
• Do not submit anything you consider confidential unless we have first signed a written non-disclosure agreement.
6. Employment Applications
The Site includes employment and current-opportunities pages. Information you provide in connection with employment inquiries or applications is used to evaluate your interest and qualifications and is handled in accordance with our Privacy Policy and applicable law. Submitting an application does not create an employment relationship or any obligation to hire.
7. Intellectual Property
All content on the Site — including text, product descriptions, drawings, photographs, galleries, logos, page design, and their selection and arrangement — is owned by Lewis or its licensors and is protected by U.S. and international copyright, trademark, patent, and other intellectual-property laws.
• Trademarks. "Lewis Bolt & Nut Company," "We Help Keep the World on Track," and product names and marks such as Viper‑1®, Evergrip®, Evergrip G2®, Permagrip®, Quick‑Set®, LT‑1, Evertite, Everlok, Anco, and Sealtite (whether or not marked with ® or ™) are trademarks of Lewis or its affiliates. You may not use them without our prior written permission, and nothing on the Site grants any license or right to use them by implication, estoppel, or otherwise. Third-party marks are the property of their respective owners.
• Patents. Certain Lewis products are patented. Nothing on the Site grants any license under any Lewis patent.
We reserve all rights not expressly granted in these Terms and will enforce our intellectual-property rights.
8. Third-Party Links and Platform
The Site may contain links to third-party websites and is hosted and operated on a third-party website platform (Wix) and supported by third-party service providers. Links are provided for convenience only and do not imply our endorsement. We are not responsible for the content, products, availability, or privacy or security practices of any third-party website or service, and your use of them is at your own risk and subject to their terms.
9. Privacy and Transmission Security
Your use of the Site is also governed by our Privacy Policy. No transmission over the internet or method of electronic storage is completely secure. Any communication you send to us through the Site or by email may not be secure, and (except for personal information governed by the Privacy Policy, or information covered by a separate written confidentiality agreement) is treated as non-confidential. Use discretion in deciding what to send us. Your privacy choices, including the "Do Not Sell My Personal Information" option, are managed through our website platform's (Wix) consent setting, as described in the Privacy Policy.
10. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, LEWIS DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. LEWIS DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR- OR VIRUS-FREE, OR THAT INFORMATION ON THE SITE IS ACCURATE, CURRENT, OR COMPLETE.
This Section 10 concerns the Site only. Any warranty relating to Lewis products is stated exclusively in the applicable quotation, order acknowledgment, or contract of sale.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL LEWIS OR ITS AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF (OR INABILITY TO USE) THE SITE, REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. LEWIS'S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SITE WILL NOT EXCEED ONE THOUSAND U.S. DOLLARS (US$1,000). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
12. Indemnification
You agree to defend, indemnify, and hold harmless Lewis and its affiliates, and their respective officers, directors, employees, and agents, from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Site or your violation of these Terms.
13. Changes to the Site and to These Terms
We may modify, suspend, or discontinue any part of the Site at any time without notice. We may also revise these Terms at any time by posting the updated Terms on the Site with a new "Last updated" date. Changes are effective when posted, and your continued use of the Site after that constitutes acceptance of the revised Terms. Please review these Terms periodically.
14. Governing Law and Jurisdiction
The Site is controlled and operated by Lewis from its offices in Wayzata, Minnesota. These Terms and any dispute arising out of or relating to the Site are governed by the laws of the State of Minnesota, without regard to its conflict-of-laws rules. You consent to the exclusive jurisdiction and venue of the state and federal courts located in Minnesota for any such dispute.
15. General
These Terms, together with the Privacy Policy, are the entire agreement between you and Lewis regarding your use of the Site and supersede any prior understandings on that subject. If any provision is held unenforceable, the remaining provisions remain in effect. Our failure to enforce any provision is not a waiver. You may not assign these Terms without our consent; we may assign them freely. Nothing in these Terms creates any partnership, joint venture, agency, or employment relationship, or any third-party beneficiary rights.
